Val Hendry had promised us a letter regarding the Region requirements for monitoring (among other matters) shortly. Please be on the lookout for that letter.

Regional Works would be preparing an agreement related to servicing and the monitoring. Wesley Tow at Works advised he will require a draft 40M plan signee off by Planning to begin the servicing agreement. I do not believe we have prepared a draft 40M plan. Steve

Subject: Agreement Required Securities for Pre-servicing

Doug; I have attached a copy of an excerpt from the Town’s standard subdivision agreement. It spells out the level of security (letter of credit) required for various phases of work.  Generally….

A)    At the time of pre-servicing, without final approval (i.e. registration) of the plan or part thereof;

  • $20,000 for replacement of topsoil, repair/maintain erosion controls, initial street cleanup
  • $50,000 silt removal, cleaning/repair storm pond, street maintenance
  • 100% of the estimated cost of services to be constructed external to the plan and or for the benefit of others

B) So assuming that preserving was undertaken, at the time of release for the plan for approval

  • 100% of all uncompleted services
  • 30%of services completed and accepted but where the full amount of services is not complete again contractors must have been paid
  • 20% of services completed and subject to inspection and acceptance and all contactors are paid.

So the intent is to as much as possible install services prior to registration of the plan and secure inspection and acceptance, payment of contractors and no liens. Under this scenario the reduced levels of security noted above in B) may be provided.
